1. Agreement

These Terms of Service (“Terms”) form a binding agreement between you and Beijing Jingqia Technology Co., Ltd. (“we”, “us”, “our”) governing your download, installation and use of the Live Weather Forecast mobile application (the “App”) and your use of this website (the “Site”). By installing or using the App, or by using the Site, you accept these Terms. If you do not accept them, do not use the App or the Site.

2. Eligibility

You must be at least 13 years old to use the App, or older where local law requires a higher minimum age. If you are under the age of majority in your jurisdiction, you may use the App only with the involvement of a parent or guardian.

3. Licence

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your personal, non-commercial purposes. You may not:

• copy, modify, translate, adapt or create derivative works of the App;
• reverse engineer, decompile or disassemble the App, except to the extent permitted by applicable law;
• rent, lease, sublicense, sell, distribute or commercially exploit the App;
• remove or obscure any copyright, trademark or other proprietary notice;
• use the App to develop a competing product or service, or to extract bulk data from it;
• interfere with, disrupt, overload or attempt to gain unauthorised access to the App, its servers or related infrastructure.

4. Weather information and no warranty of accuracy

Weather data is obtained from third-party meteorological sources and forecast models, and is provided on an “as is” and “as available” basis. Forecasts are inherently probabilistic:

• short-range forecasts are generally more reliable than long-range outlooks; the extended outlook beyond the first week is indicative only;
• radar, air quality, UV and related readings depend on the coverage and quality of the underlying data for your region;
• location detection can be imprecise, and the forecast shown may correspond to a nearby area rather than your exact position.

We do not warrant that the information provided is accurate, complete, current or suitable for any particular purpose. Do not rely on the App as your only source of weather information where safety is involved.

5. Advertising and in-app purchases

The App is free to use and supported by advertising. A one-time in-app purchase is available to remove advertising permanently. Purchases are processed by Google Play and are subject to Google Play’s terms and refund policy; we do not process payment card details ourselves and cannot directly issue refunds, although we will assist you in contacting Google Play where appropriate. The ad-free entitlement is attached to the Google account that made the purchase and can be restored on other devices signed in to that account.

6. Availability and changes

We may release updates, add features, change features or discontinue features at any time. We do not guarantee that the App will be available on any particular device or Android version, that it will operate without interruption, or that the App will continue to be offered in any particular country. Features dependent on third-party data sources may be changed or withdrawn if those sources change.

7. Intellectual property

The App, the Site, and all content, design, graphics, icons, text and software within them are owned by us or our licensors and are protected by copyright, trademark and other intellectual property laws. The names “Live Weather Forecast”, “Ten Stars Lab” and “Jingqia”, and the associated visual identity, are our marks. These Terms grant you no right to use them except as necessary to use the App as intended.

8. Acceptable use

You agree not to use the App or the Site:

• in violation of any applicable law or regulation;
• to infringe the rights of any third party;
• to transmit malicious code, or to attempt to compromise the security or integrity of our systems or those of our partners;
• to access data through automated means other than as expressly permitted by us.

We may suspend or terminate access where we reasonably believe these Terms have been breached.

9. Privacy

Our handling of personal information is described in the Privacy Policy, which forms part of these Terms. Permissions requested by the App, including location access, are used for the purposes set out in that policy. You may revoke permissions at any time in your device settings, although some functionality may then be unavailable.

10. Third-party services

The App and the Site may link to or rely on third-party services, including Google Play, weather data providers and advertising partners. We are not responsible for the content, policies or practices of those third parties, and your use of them may be governed by their own terms.

11. Disclaimer and limitation of liability

To the maximum extent permitted by applicable law, the App and Site are provided without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or business opportunity, arising out of or in connection with your use of the App or the Site. Where our liability cannot be excluded, it is limited to the greater of the amount you paid us in the twelve months preceding the claim, or USD 10.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

12. Indemnity

You agree to indemnify and hold us harmless from claims, losses, liabilities and reasonable expenses arising from your breach of these Terms or your misuse of the App or the Site.

13. Termination

You may stop using the App at any time by uninstalling it. We may terminate or suspend your licence if you materially breach these Terms. Sections concerning intellectual property, disclaimers, limitation of liability, indemnity and governing law survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the People’s Republic of China, without regard to conflict of law principles. Subject to any mandatory consumer protection provisions in your country of residence, disputes arising out of or relating to these Terms shall be submitted to the competent court in Beijing, China. Nothing in this section prevents you from bringing a claim before a consumer protection body or court that is competent in your place of residence where local law grants you that right.

15. Changes to these Terms

We may revise these Terms from time to time. The updated version will be posted on this page with a new effective date. Material changes will be notified in the App or on the Site before they take effect. Continued use of the App after the effective date constitutes acceptance of the revised Terms.

16. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and any additional terms shown in the App, constitute the entire agreement between you and us regarding the App and the Site.
